Terms and Conditions and Liabilities

  1. The ‘Hirer’ means the person submitting the booking confirmation & order form and paying the deposit.
  2. A damage deposit of £30 is required to secure your booking, this is in addition to the balance and will be refunded 24 hours after collecting the kit providing nothing is damaged.
  3. Final balances are required  prior to the party. This can be made via Paypal or by bank transfer  
  4. The final numbers and choices must be confirmed at least 7 days prior to the booking date.  1 week if personalised items are required.  Any reductions after this time will still be charged for at the original agreed rate.
  5. The Hirer is responsible for ensuring the accuracy of the information given to Goodnight Sleepovers and Events and to pass such information in sufficient time for Goodnight Sleepovers and Events  to perform the contract safely and without risk (usually within 14 days prior to any event.)
  6. Goodnight Sleepovers and Events reserves the right to make any changes to the services as is deemed reasonable and necessary without notice to the Hirer. If the required service is less than originally requested the requisite refunds will be made to the Hirer.
  7. The Hirer is responsible/liable for any damage or injury occurring from or as a result of inappropriate use or misuse or reckless use of any of Goodnight Sleepovers and Events equipment. The tents are set up for sleeping in ONLY and are not be used as a play area.   An adult is required  to supervise children at all times.  Roughhousing, play-fighting, running, pillow-fighting, playing tag or anything equivalent to this is strictly forbidden and may cause damage or injury to property and/or persons.  Goodnight Sleepovers and Events  take no responsibility for tents falling down/over in instances such as the above.The Tents are designed in such a manner that they cannot fall over of their own accord. And as such Goodnight Sleepovers and Events take no responsibility if any of the equipment including the Tents do not remain upright and for any damage caused to persons and or property in the result of Tents or equipment that has fallen.
  8. It is the Hirer's responsibility to ensure that the children are supervised at all times. Goodnight Sleepovers and Events may charge the hirer for the costs incurred for replacement or repairs to any property caused by any breach of this clause.
  9. It is the Hirer's responsibility to ensure the children comply with all reasonable instructions from Goodnight Sleepovers and Events to ensure the safety of the attendees and other persons present. Goodnight Sleepovers and Events  may suspend the event if any persons are in breach of this clause.
  10. Goodnight Sleepovers and Events accept no liability or responsibility to the Hirer for any damages, costs, losses, claims, expenses, demands and proceedings including property of Hirer and their guests, or any consequential loss in these regards.
  11. Goodnight Sleepovers and Events  shall use all reasonable endeavours to provide the services in accordance with the contract and shall perform the services with reasonable skill, care and due diligence and in accordance with all health and safety regulations in force at this time.
  12. Goodnight Sleepovers and Events shall process all data in accordance with the Data Protection Act 2018 and the GDPR.
  13. It is not the intention of Goodnight Sleepovers and Events to violate any copyright laws and all themes are only inspired by popular trends.
  14. The individual tents are not suitable for outside use and are for indoor use only.  All equipment/products are not suitable for children under 36 months Please note: a damaged goods invoice will be issued in the event of any loss or damage, the hirer will be liable to pay the invoice and accepts this fact upon proceeding with their booking. 
  15. When ordering any personalised goods, the entire party package must be paid for in full before printing commences. The personalisation/name (s) written on the invoice will be exactly what is printed, it is the client’s responsibility to check spellings are correct upon receiving the invoice and pre-party information sheet and prior to paying the deposit.
  16. All images Goodnight Sleepovers and Events post, send or advertise are for illustrative purposes only and may not bean exact representation of what the hirer receives
  17. “I’ll do it all myself “ Package – The Hirer agrees to set up, take down all equipment to Goodnight Sleepovers and Events. Timings will be agreed in writing a week before the Party is due to take place.  Any changes to these agreed timings must be agreed by both parties. 
  18. Goodnight Sleepovers and Events will deliver, setup, take down and take away the equipment.  Timings will be agreed a week before the party is due to take place.  
  19. Please bear in mind however, that we cannot guarantee your delivery time due to situations beyond our control. We ask you allow an adequate time frame for situations such as these.
  20. It is the responsibility of the Hirer to ensure that enough space is available to set up the required number of tents.  Goodnight Sleepovers and Events.  If the party is unable to take place due to lack of space there will be no refund.
  21. Goodnight Sleepover and Events representatives are not allowed to move furniture.
  22. Bell Tent: clients are responsible for ensuring there is adequate space for the equipment to be erected,
    Goodnight Sleepovers and Events will not refund any monies paid in the event that adequate space is not available for set up.
  23. We regret the Bell tent is not suitable for animals of any kind.
  24. All of our bookings are strictly no smoking.
  25. All rubbish, waste recycling or personal items must be removed from all our tents prior to collection.
  26. Candles with flames are not permitted inside our tents. 

Supervision

  1. The Hirer is responsible for the care and safety of all children attending & should ensure that all parent/guardians are aware Goodnight Sleepovers and Events is not responsible for the care and safety of children.
  2. The Hirer will be required to take responsibility and adequate care for all children left by their parent/guardian/carer.
  3. During set-up and take down of the equipment, do not allow any children or pets on or in the equipment as this may cause injury. The set-up and take down of equipment must only be performed by either a Goodnight Sleepovers and Events employee or an adult over the age of 18.
  4. If the Hirer is setting up and taking down the equipment themselves Goodnight Sleepovers and Events accept no responsibility for injury, damages, costs, losses, claims, expenses, demands and proceedings including property of Hirer and their guests, or any consequential loss in these regards.
  5. Please ensure that the area in which the party is to be held is clean and tidy and that the environment is kept smoke free.
  6. Any additional cleaning as a result of damage to the hired equipment by pets or smoke or other strong odours may result in an additional charge.
  7. The tents must not be located next to an open flame such as candles, open fires, gas fires or any other source of flammable substance. All lights provided by Goodnight Sleepovers and Events are LED battery operated and may be left on safely overnight if required.
  8. THIS EQUIPMENT IS HIRE USE ONLY. It will not be supplied in a brand-new condition, as it will have been previously hired, and as such some products may be marked. 

 

Cancellation (by the Hirer)

 

Cancellation (by Goodnight Sleepovers and Events )

  1. Goodnight Sleepovers and Events reserves the right (in the unlikely event) to cancel the booking at any time for any reason. Goodnight Sleepovers and Events will try to give as much notice as possible.
  2. Upon any such cancellation Goodnight Sleepovers and Events will refund to the Hirer any monies paid to Goodnight Sleepovers and Events  in respect of the bookings. Goodnight Sleepovers and Events will not be liable to pay any compensation to the Hirer or any other person for any loss, damage or expenditure arising directly or indirectly from any cancellation.
  3. Goodnight Sleepovers and Events reserve the right to terminate the booking without notice if there is a breach of any conditions by the hirer.

 

Liability 

  1. Nothing in these terms shall limit or exclude the liability of Goodnight Sleepovers and Events which may not be limited or excluded by law, including without limitation liability for death or personal injury caused by Goodnight Sleepovers and Events or fraudulent misrepresentation.
  2. Subject to the above Goodnight Sleepovers and Events have no liability (whether arising under contract, tort, or for breach of statutory duty or otherwise) to the extent that such liability would not have arisen but for the Hirer’s breach of the contract.
  3. Subject to the above clauses Goodnight Sleepovers and Events liability for all claims in relation to the contract (whether arising under contract, tort, or for breach of statutory duty or otherwise) shall not exceed the price paid by the Hirer.
  4. This contract is governed and construed in accordance with English law and the parties irrevocably submit to the exclusive jurisdiction of the courts of England.
  5. No information included in this booking form will be disclosed to any third party.
  6. It is the responsibility of the Hirer to inform guests accordingly of the above terms and conditions.
  7. Goodnight Sleepovers and Events Public Liability Insurance and takes the utmost care to ensure the safety of all sleepover party guests at all times.
  8. Liability cannot be taken for reactions or injury sustained whilst attending a party or thereafter.
